The Arizona Court of Appeals’ April 28, 2026 opinion requires voting and formal action in open meetings and meaningful agenda information under A.R.S. § 33-1804. It also recognizes that a board may delegate identification of grounds for closed meetings and that agendas need not disclose personal identifying or attorney-client privileged information. The court affirmed in part, reversed in part, and remanded for further proceedings. See paragraphs 14–16 and 22–25. This decision concerns another association, not Santa Rita Ranch III.
The Arizona Supreme Court docket records denial of the petition for review by an order dated September 8, 2026, filed September 9, and closure of the review case on September 9. The docket is dated September 9, 2026. Subsequent proceedings on remand have not been independently verified for this site.
The Arizona Department of Real Estate describes an HOA dispute process that may refer qualifying owner–association disputes to the Office of Administrative Hearings. ADRE also states that it does not investigate or regulate HOAs and cannot provide legal advice.
